General Conditions of the Service

(pursuant to Chapter I, Title 3, Part 3, Legislative Decree no. 206/2005 and subsequent amendments and additions)

1. Premise and effectiveness of the General Conditions

These General Terms and Conditions of Sale (hereinafter referred to as “General Terms and Conditions”) have as their object the regulation of the purchase of products made at a distance and made available, through the internet, from the website www.aziendaloghi.com (hereinafter referred to as the “Site”) in compliance with the Italian legislation of Legislative Decree 206/2005 and subsequent amendments and additions (hereinafter, “Consumer Code”).

The seller of the products and owner of the Site is:

The consumer who accesses the Site to make purchases (hereinafter “Customer”) is required, before sending the order, to read carefully these General Conditions that have been made available to you on the Site and that will be available at any time by the Customer also through the link contained in the email confirming each order to allow the reproduction and the memorizing

In the event that the person making purchases on the Site requests the issue of an invoice and/or in any case is not a “consumer or user” as defined in art. 3, paragraph 1, lett. a), of the Consumer Code, will not apply the rules of withdrawal referred to in art. 7 and 8 of these General Conditions and, more generally, the provisions that under the same Consumer Code apply only to “consumers”.

The contracts concluded with LOGHI through the Site are governed by these General Conditions in compliance with Italian law. The language available to conclude the contract is Italian

2. Choose and order the Products

The characteristics and the price of the various products on sale on the Site (hereinafter “Product” or “Products”) are shown on the page relating to each Product.

For the purchase of the Products, the Customer must fill in and send the order form in electronic format, following the instructions contained in the Site. The Customer must add the Product to the “Cart” and, after having read the General Conditions and the Privacy Policy and confirmed their acceptance, must enter the shipping data and any invoicing, select the desired payment method and confirm the order.

By sending the order from the Site, which has the value of a contractual proposal, the Customer acknowledges and declares to have read all the information provided to him during the purchase procedure and to fully accept these General Conditions and payment transcribed.

The contract between LOGHI and the Customer must be understood as concluded with the acceptance of the order by LOGHI. This acceptance is communicated to the Customer through an email confirming the order containing a reference to these General Conditions, the order number, the shipping and billing data, the list of products ordered with their essential characteristics and the total price, including delivery costs. The Customer will check the confirmation email and if you find any errors in the order will have 12 hours from the receipt of such email to contact the Customer Service directly from the Site using the appropriate contact form accessible through the tab “Contacts”. After this period, the order will be processed for shipment and changes will no longer be accepted, without prejudice to the rights of the Customer referred to in article 7 below.

Once the order has been received, LOGHI will check the availability of stocks for the fulfillment of the order. In the event that one or more Products are not available, the Customer Service will send timely communication via email to the Customer who, within the next 12 hours, may reply to confirm the shipment of any additional Products available or cancel it. In case of failure to reply within this deadline, the order will be considered confirmed and the available Products will be shipped. In this case, the entire amount relating to the missing Products will be cancelled or in any case, depending on the payment method chosen, will not be charged to the Customer.

3. Information on the Products

The information and characteristics relating to the Products are available, with the relevant product codes, on the Website.

The visual representation of the Products on the Site, where available, normally corresponds to the photographic image accompanying the descriptive card. It is understood that the image of the Products has the sole purpose of presenting them for sale and may not be perfectly representative of its characteristics and quality but may differ in color and size. In case of difference between the image and the written product sheet, the description of the product sheet is always valid.

4. Prices and dispatches

The prices of the products are inclusive of all taxes. All prices are expressed in Euro. The price of the fresh product is often subject to unpredictable variations and the user may notice upward or downward fluctuations. Also for this reason we do not accept reservations, they would not allow us to determine in advance the price to be paid. The cost of the shipments varies according to the total weight of the purchased products and the final place of destination of the delivery. In the Shopping Cart page, and then in the Checkout page, the user can view the actual cost of the shipment (specifying also the destination of the goods) before proceeding with the order confirmation.

Deliveries are made in all the EU

  • Shipments in Italy:

Shipments within the Italian territory take place via Corriere Espresso GLS.

  • Shipments to Abroad:

Shipments outside the Italian territory, but within the EU, take place via Corriere Espresso DHL.

5. Methods of payment and invoicing

5.1 Methods of payment

The Customer may pay the price of the Products and the related delivery charges by Paypal, bank transfer and cash on delivery.

  • Paypal/Credit Card

Once the order is confirmed, the customer can pay directly with his Paypal account or use a credit card, even prepaid, or in any case according to the methods accepted by Paypal

  • Bank transfer

The Customer must make the transfer within 3 days from the date of the order for orders related to products and within 1 day from the date of the order for orders containing events and/ or courses. In case this does not occur, the order will be cancelled and the goods made available again for purchase by other customers. The Customer who has not provided for the transfer can be contacted by the Customer Service in order to clarify whether the reason for the failure to credit is due to the Customer’s will not to confirm the purchase or other causes.

Reason: the Customer must indicate in the purpose of the transfer the date and the order number, available in the confirmation email (e.g. “Order 01/01/14 n. 100012345”).

  • Mark

This payment method is only available for shipments made in Italy and only for orders of no more than €500.00. Payment will be made upon receipt of the Products and may be made exclusively in cash. For shipments on delivery, the customer is required to pay a shipping fee of 3.00 € + 3% of the total expenditure.

5.2 Invoicing of orders
If the purchase is made by a professional, it will be possible to request the issuance of the invoice by selecting the appropriate box during the order procedure and entering the billing data including tax code and/ or VAT number. In this case the invoice will be sent by email to the address indicated. The professional is responsible for the correct insertion of the billing data and is expressly informed that, in case of failure to request the invoice at the time of order, it will not be possible to request it later.

6. Transport and delivery

The Products purchased on the Site will be delivered to the address indicated by the Customer during the purchase procedure in the appropriate field “Shipping Data”.

All purchases will be delivered by express courier (hereinafter “Courier”) from Monday to Friday, excluding holidays and national holidays. LOGHI is not responsible for unforeseeable or unforeseeable delays.

Once the Products have been shipped, the Customer will receive a confirmation email in which a link will be included for tracking the shipment.

In any case, except in cases of force majeure or unforeseeable circumstances, the Products ordered will be delivered within a period of 3 (three) working days from the day following the day on which LOGHI confirmed the order to the Customer by means of a specific order confirmation email.

7. Right of withdrawal

The Customer has the right to withdraw from the contract as established by Legislative Decree no. 21 of 21 February 2014.

To exercise the right of withdrawal, the customer is required to follow what is expressed in the page of this site dedicated to the right of withdrawal.

8. Errors and limitations of liability

The information about the Products provided through the Site is constantly updated. However, it is not possible to guarantee the complete absence of errors of which LOGHI cannot be held liable, except in case of intent or gross negligence.

LOGHI reserves the right to correct errors, inaccuracies or omissions even after an order has been sent, or to modify or update the information at any time without prior communication, without prejudice to the rights of the Customer pursuant to these General Conditions and the Consumer Code.

Except in the event of intentional or gross negligence, any right of the Customer to compensation for damages or to the recognition of compensation, as well as any contractual or non-contractual liability for direct or indirect damages to persons and/or property, caused by the non-acceptance or evasion, even partial, of an order.

LOGHI promotes the responsible consumption of alcohol and excludes any liability at its own expense, except wilful misconduct or gross negligence, in the case of purchase made by minors under 16 years.

9. Applicable law and jurisdiction

The sales contract between the Customer and LOGHI is concluded in Italy and regulated by Italian law. For the resolution of disputes relating to the interpretation, execution or resolution of these General Conditions or individual purchase orders if the Customer is a consumer pursuant to the Consumer Code, The exclusive jurisdiction will be the jurisdiction of its municipality of residence or domicile if located in the Italian territory; in all other cases, the territorial jurisdiction is exclusively that of the Court of Siena, any other jurisdiction excluded.
